Using Famlistry means agreeing to this. It is short, and it is meant to be read rather than clicked past.

What Famlistry is

A place to keep your family stories: recordings, writing, photographs and video, shared with the people you invite and nobody else. It is free. There is no advertising, and nothing you put in is sold or handed to an advertiser.

Your account

• You must be at least 13 to create one, and the details you give must be yours and correct.
• One person, one account. Keep the password to yourself; anything done from a signed-in device is treated as done by you.
• If you think somebody else is in your account, change the password and end the other devices from the security screen in settings, then write to support@famlistry.com.

What you put in stays yours

You keep every right you have in your recordings, writing and files. Famlistry is given only what running the service needs: storing them, making the smaller copies a browser can show, showing them to the family you shared them with, and putting them in an archive when you ask for one. Nothing here is a licence to publish your family archive or to use it for anything else.

Post what is yours to post. A photograph of somebody else is a normal thing to keep in a family archive; putting one somewhere its subject would object to is your decision and your responsibility, and the family you share with is the audience you chose.

What not to do

• Break the law with it, or use it to harass, threaten or impersonate somebody.
• Upload material you have no right to, or anything sexual involving a child - that one is reported rather than argued about.
• Attack the service: break into an account that is not yours, hammer it with automated requests, or work around a limit rather than asking about it.
• Use it to send bulk mail, host files for something unrelated, or resell it.

Break those and the account can be suspended, and in a serious case deleted. Where it is not serious you will be told what the problem is and given a chance to put it right first.

Leaving, and being asked to leave

You can deactivate or delete your account at any time from settings, and take a copy first with the export - the offer to do that sits above the button that destroys it, on purpose. Deleting is permanent. What it destroys and what it deliberately leaves behind is set out on the privacy page, and it is worth reading before you press it.

Famlistry can close an account for the reasons above. If the service itself is ever shut down, you get at least thirty days of notice at the address on your account and the export keeps working for the whole of it, so nothing has to be lost.

What is not promised

Famlistry is provided as it is. It is backed up nightly and built to keep what you give it, and it is not a guarantee: no service is, and a family archive that exists in exactly one place is a risk whoever runs that place. Keep your own copy of anything you cannot bear to lose - the export exists for that, and it takes a minute.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited. Beyond that, and to the extent the law allows, Famlistry is not liable for indirect or consequential loss.

Changes

These terms can change. A change that matters will be sent to the address on your account before it takes effect, and carrying on using Famlistry afterwards is how you accept it. If you would rather not, delete the account and take the export with you.

These terms are governed by the law of the Province of Ontario and the federal law of Canada that applies in it. Questions about any of it go to support@famlistry.com.
